Using EmoXCare App

By downloading, installing, registering, accessing, or using the EmoX app (referred to as the "App"), you agree to be bound by the following terms and conditions (referred to as the "Terms"). Please read these Terms carefully before using the EmoxCare App.
Services Provided
The services offered by the app are 1. Generative AI chatbots will chat and guide users through emotional therapy based on the text they enter, voice messages, or other choices; 2. Self-healing exercises, mental-health assessments and reports. These Terms grant you the right to use the App to benefit from the service within the defined scope. You may not in any way copy or modify the App, any part of the App, or our trademarks. You may not attempt to extract the source code of the App or attempt to translate the App into other languages or create derivative versions. The App itself and all trademarks, copyrights, database rights, and other intellectual property rights related to it remain the property of OCAAT HEALTH LIMITED. ("OCAAT HEALTH LIMITED.").
Changes to the App and Charges
OCAAT HEALTH LIMITED. is committed to ensuring that the App is as useful and efficient as possible. Therefore, we reserve the right to make changes to the App or charge for its services, at our discretion and for any reason. We will not charge you for the services of the EmoxCare App without clearly informing you of the exact payment content.
Data Processing and Security
To provide our services, the EmoxCare App stores and processes the personal data you provide to us. You are responsible for ensuring the security of your phone and access to the EmoxCare App. Therefore, we recommend that you do not jailbreak or root your phone, as this may make your phone vulnerable to malicious software/viruses/malware, compromise the security features of your phone, and may prevent the EmoxCare App from functioning properly.
Limitations and Liability
OCAAT HEALTH LIMITED. is not responsible for the EmoxCare App losing full functionality due to lack of an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but if you are unable to access Wi-Fi and have no remaining data allowance, EmoxCare INC. cannot be held responsible for the EmoxCare App losing full functionality. If you use the EmoxCare App in an area without Wi-Fi coverage, you should be aware that the terms of your agreement with your mobile network provider still apply. Therefore, you may need to pay your mobile provider for data usage during the connection, or other third-party fees, when accessing the EmoxCare App. By using the EmoxCare App, you are responsible for such charges, including roaming data charges incurred when using the EmoxCare App outside your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device used to access the EmoxCare App, please note that we assume that you have obtained permission from the bill payer.
Similarly, OCAAT HEALTH LIMITED. is not always responsible for how you use the EmoxCare App, and you are responsible for ensuring that your device remains charged - if the battery runs out, preventing you from opening the EmoxCare App to use OCAAT HEALTH LIMITED. services, OCAAT HEALTH LIMITED. will not be liable.
Regarding OCAAT HEALTH LIMITED.'s liability for your use of the EmoxCare App, when you use the EmoxCare App, it is important to note that while we strive to ensure that it is always up-to-date and correct, we rely on third parties to provide us with information in order to provide it to you.
App Updates
In some cases, we may wish to update the EmoxCare app. The EmoxCare app currently supports the iOS platform - system requirements (and any other systems we decide to expand the app to) may change, and if you wish to continue using the EmoxCare app, you will need to download the update. OCAAT HEALTH LIMITED. does not guarantee that the EmoxCare app will always be updated to be compatible with the iOS version installed on your device and meet your needs. However, you agree to always accept the updates provided to you for the application. We may also wish to stop providing the EmoxCare app and may terminate its use at any time without notifying you of the termination. Unless we notify you otherwise, upon termination: (a) the rights and licenses granted to you under these terms will end; and (b) you must stop using the EmoxCare app and, if necessary, delete it from your device.
User Content
You may provide, upload, transmit, create, store, use, edit, or share data, information, phrases, entries, text, questions, materials, files, links, selections, messages, and images, etc. (Input) through the service; and receive content such as phrases, text, responses, and works created or generated by the service (Output) (Input and Output collectively referred to as User Content). You may only provide, upload, transmit, create, store, use, edit, and share User Content if it complies with these terms and conditions, including OCAAT HEALTH LIMITED.'s end-user license agreement and any other applicable laws.
You represent and warrant that you own the Input Content; and have all consents, permissions, licenses, and rights necessary to provide and license the Input Content as described in these terms and conditions; You also have the legal capacity to provide and license the Input Content in the relevant jurisdiction and to enter into these terms and conditions.
From the time you upload or transmit Input Content, you grant OCAAT HEALTH LIMITED. a non-exclusive, irrevocable, fully-paid, royalty-free, perpetual, sublicensable, transferable, worldwide license and right to store, use, broadcast, copy, modify, create derivative works, record, sublicense (multilevel), translate, transmit, publish, publicly display, or otherwise exploit for the limited purposes of operating, improving, troubleshooting, debugging, protecting, and customizing OCAAT HEALTH LIMITED. and its affiliates' existing and future products, including but not limited to training EmoxCare, developing new features or future products, and in any known or future developed technology, in any format and media, without notice, permission, payment, or providing any additional compensation to you or third parties.
OCAAT HEALTH LIMITED. does not endorse, approve, verify, or control User Content and has no obligation to monitor User Content, your use of the service, or the supervision of any content provided by third parties. You are solely responsible for User Content and the consequences of posting or publishing User Content in any way, and you warrant that User Content does not violate any applicable laws and these terms and conditions (including OCAAT HEALTH LIMITED.'s end-user license agreement). Furthermore, you understand and agree that OCAAT HEALTH LIMITED. is not responsible or liable for User Content and materials that may be copyrighted, such as literary works, phrases, entries, texts, and other materials that may be provided or exist in the service.
Usage Notice
You understand and agree that:
(i) The Output is generated by artificial intelligence;
(ii) The Output may be false, inaccurate, or misleading;
(iii) OCAAT HEALTH LIMITED. does not represent or warrant the accuracy, truthfulness, or applicability of the Output, nor is it suitable for your use or needs;
(iv) The Output does not constitute advice, guidance, or information provided by OCAAT HEALTH LIMITED. in any way;
(v) OCAAT HEALTH LIMITED. has no responsibility or obligation regarding the Output;
(vi) You use any Output at your own risk;
(vii) You should not rely on EmoxCare as your sole source of information.
Furthermore, you understand and agree that, due to the same or similar Input provided by other users, the same or similar Output may be received, and the Output may not always be unique. You understand and agree that you cannot use EmoxCare to mislead any third party into believing that the Output is generated solely by humans.

By viewing and using this APP, including but not limited to chat messages, assessments and reports, audio, video, email, social media and / or other communications (collectively, the “App” ), you agree to be bound by this Disclaimer .

1. The information provided in or through this App is only used as a self-care tool for personal chat companionship and mental health management for non-medical needs.
2. The chatbot’s conversational content is not medical, mental health, or religious advice. The bot is not a real doctor / physician, nurse, physician assistant, advanced practice nurse or any other medical professional ( “ Medical Provider ” ), psychiatrist, psychologist, therapist, counselor or social worker ( “ Mental Health Provider ” ), registered dietitian or licensed nutritionist, or member of the clergy. As a chatbot powered by generative AI technology, it does not provide direct health care, medical or nutritional therapy services, or attempt to diagnose, treat, prevent or cure any physical, mental or emotional problem, disease or condition. The information provided in or through my App regarding your career or clients or any other aspect of your life is not intended to replace professional medical advice, diagnosis or treatment provided by your own medical provider or mental health provider. You agree and acknowledge that I do not provide medical advice, mental health advice or religious advice in any way. User Status
